Background and experience
The
real world experience that our lawyers have gained in holding both

MEDICAL
MALPRACTICE |
|
Medical malpractice claims are extremely
complicated. Most medical malpractice claims that fall under Louisiana
law must be brought within one year of discovery of the malpractice,
but in no event later than within three years of the malpractice.
Because of these time restrictions, we actively investigate whether
our clients have been subject to medical malpractice in a prompt and
professional manner. In Louisiana, most medical malpractice claims
must first be submitted to a Medical Review Panel before filing suit
in court. If necessary, The Bagert Law Firm will retain a doctor in
the appropriate specialty to review your case and testify as to
whether or not the appropriate medical standard was followed. We will
also determine if a fully informed consent was obtained from you prior
to the medical procedure. The Bagert Law Firm can assist you in
determining whether malpractice caused or worsened your injury and in
recovering the damages you suffered because of medical negligence.

Ben
Bagert is one of Louisiana's very experienced litigators and has
practiced widely before district and appellate courts in Louisiana,
Texas, Mississippi. He has also represented clients in administrative
matters before state and federal administrative agencies and has
acted as lead counsel in over thirty reported appellate decisions.
He was admitted to the Louisiana Bar in 1968 after graduating from
Loyola University Law School where he was honored by induction into
Blue Key National Honor Fraternity, was elected president of the
law school student body, and published textbooks in the fields of
Louisiana Successions and Family Law. He is admitted to practice
before the United States Supreme Court, the U.S. 5th and 11th Circuit
Courts of Appeal and he has testified before committees of the United
Sates Congress on several occasions. He is the lead author of the
Louisiana Code of Evidence, the Louisiana Controlled Substances
Act, and is a member of the Council of the Louisiana State Law Institute
and its evidence advisory committee. For 22 years Mr. Bagert served
as a member of the Louisiana State Legislature as a member of the
State House and also the State Senate where he chaired several committees
including the Judiciary Committee, the Commerce Committee, the Joint
Committee on Insurance Matters, and the Joint Committee on Utilities
Regulation. He has been a guest lecturer at the Tulane, Loyola,
and LSU law schools. |

The Bagert Law Firm is ready to do what ever it takes to help our
friends, our clients, and our community recover from the suffering and
disruption of Katrina.
All of our client data and physical files
are completely safe and intact. Before the
storm, all of our electronic data was backed up and removed from New
Orleans. It has been completely restored. This includes our accounting
records, legal research, email and all other electronic data and
files. We have secured our physical files many of which have been
removed to our expanded Baton Rouge office.
Because of our pledge to assist in the recovery, we have begun
providing competent legal services in additional areas of the law that
few Louisiana lawyers ventured prior to the storm. We are now prepared
and able to help in areas such as disaster law and FEMA
regulations and related matters. Naturally, we have always
practiced in fields of insurance coverage and claims and will continue
to do so.
